Terms and conditions

These General Terms and Conditions apply to all contracts between G6 Agency AG, Bahnhof-Park 2, 6340 Baar, Switzerland (UID: CHE-333.056.061 MWST), hereinafter SICE, and its customers concerning the Zertify platform.

The offer is directed at businesses and self-employed persons. Deviating terms of the customer apply only if SICE agrees to them in writing.

The subject matter is an online self-assessment for a chosen ISO standard and, if the assessment is passed and payment is made, the issue of a certificate with a unique number, QR code and public verification page. An audit report, additional locations and additional standards can be ordered optionally.

The assessment is free. The issue of the certificate and the chosen additional services are subject to a fee.

The certificate is based solely on the customer's statements in the self-assessment. SICE does not carry out an on-site audit and is not an accredited certification body. The certificate is not an accredited certification within the meaning of the relevant standards and legal provisions.

It is suitable as proof towards customers and partners, but not where an accredited certification is prescribed or required, for example in public tenders or regulated sectors. Checking whether the certificate meets the requirements of the recipient is the customer's responsibility.

The presentation of services on the website is not a binding offer. The contract is concluded when the customer completes the order in the checkout and SICE confirms the order. Confirmation is sent by email.

The prices shown on the website at the time of the order apply, in Swiss francs (CHF) or euros (EUR). Prices are fixed prices per standard. Discounts may be granted for several standards in one order and are shown in the checkout.

Where value added tax applies, it is shown in the checkout. The total amount shown in the checkout is decisive.

Payment is made in advance by credit card through the payment provider Stripe. The invoice is sent by email. If payment fails, no certificate is issued.

SICE usually issues the certificate within 4 hours, at the latest within 24 hours of receipt of payment, and provides it as a PDF and through the customer account. The period is a guideline. It may be extended in the event of technical faults or queries about the customer's statements.

Every certificate can be checked on the public verification page using the certificate number or the QR code.

The certificate is valid for three years from the issue date unless it is revoked earlier. After expiry, the status is shown accordingly on the verification page. Renewal is possible through a new assessment and payment of the renewal price in effect at the time.

The customer undertakes to complete the assessment truthfully and completely and to use it only for its own business. Changes that materially affect the result must be reported to SICE without delay.

The certificate and the website badge may only be used unchanged and in a way that does not suggest an accredited certification or certification by a public authority. The customer may not extend the scope of the certificate, for example to other locations or companies.

SICE may revoke a certificate with immediate effect if the assessment contained false or misleading statements, if the certificate or badge is misused or if the customer materially breaches these terms. The status on the verification page is then set to revoked.

In the case of revocation for false statements or misuse there is no entitlement to a refund. Further rights of SICE remain reserved.

Because the offer is directed at businesses and the service is performed immediately at the customer's request, there is no statutory right of withdrawal. Statutory rights that cannot be excluded remain unaffected.

SICE is liable for damages only in cases of intent or gross negligence. Liability for slight negligence, for indirect damages, consequential damages, lost profit and loss of data is excluded to the extent permitted by law.

SICE is not liable for third parties accepting the certificate. Liability is limited in amount to the price paid for the service concerned, to the extent permitted by law. Mandatory statutory liability, for example for personal injury, remains unaffected.

The processing of personal data is governed by the Zertify privacy policy.

SICE may change these terms at any time. For orders already placed, the version published at the time of the order applies.

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict of law rules. The exclusive place of jurisdiction is Zug, unless mandatory provisions provide otherwise.

Should a provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
